Middlebury Police Chief James Viadero said officers were dispatched to 68 Woodfield Drive Wednesday at approximately 4:44 p.m. because of an unwanted party on the property. The party was the homeowner’s ex-husband, Edward Dest, 52.
Officer Demers, first on the scene, was joined by Viadero. The complainant advised Officer Demers that Dest had been at her home earlier, entering without permission, and had come back a second time.
Dest was there when officers arrived. He is not authorized to be at the residence and has special conditions he must adhere to in order to have visitation with his children.
When Demers arrived, Dest attempted to leave the scene and had to be instructed several times to remain in his vehicle while information was obtained from the complainant. After being instructed several times to remain in his car, Dest attempted to drive away from the scene. Officer Demers stepped towards the vehicle and instructed Dest to put the car in park and exit his vehicle. Dest refused to comply and attempted to drive off, stating, “I’m going home.”
At this point Dest was ordered to step out of his vehicle. He refused. The officers opened the car door and physically removed him from the vehicle. Officer Demers and Chief Viadero took hold of Dest, who was noncompliant, and had to take him to the ground in an attempt to gain control of his arms, which he held tightly underneath his body.
Demers was able to place a handcuff on Dest’s left wrist, while Viadero gained control of his right wrist, which Dest continued to hold under his body near his waistline. The suspect was then handcuffed without further incident.
While officers were struggling with Dest, they detected an odor of alcohol and a subsequent field sobriety test and breathalyzer test indicated he was under the influence of alcohol.
Dest was charged with second-degree criminal trespass, interfering with/resisting arrest and driving while intoxicated. His bond was set at $52,500. He posted bond and is due to appear in court in Waterbury Nov. 4, 2015.
